Estates, Wills, & Trusts

This lecture rounds out our look at property law with a discussion of the disposition of our property after death, with some variations on its disposition prior to death. PLEASE NOTE we will also cover the Power of Attorney material from Lecture 7.

Materials: Read Miller & Jentz Chapter 30 (the sections on wills and trusts); you may also want to review the applicable portions of Chapters 28 and 29. Read this sample will; it's pretty generic, but does contain all the basics and gives you a good idea of the kind of wording commonly used in a formal will. Pay particular attention to Paragraph 3(d), which creates a trust as part of the execution of the will.
