Contract Performance

Once a contract is made and its validity confirmed (meaning its validity is either unchallenged or any such challenge has been defeated), it must be performed (carried out). Each party is obligated to carry out each and every one of the contract provisions to the standards set forth in the contract. Failure to do so may result in breach and damages, or in some cases damages even without breach. We will cover equitable contracts in some detail, third party rights somewhat less so.

Materials: Review Miller & Jentz Chapter 7 concerning equitable contracts.  Read Miller & Jentz Chapters 11 (you may just scan the third party info) and 12. These are the lecture slides and this is the downloadable file of the lecture, available during and after the TTh 12-2 class meeting.
